Rezoning Application – 9 Montrose Avenue (Erf 720)
Kewlett Investments has submitted a formal application to the City of Johannesburg to rezone Erf 720, situated at 9 Montrose Avenue, Craighall Park, from Residential 3 to Business 1.
The property has already been redeveloped and now hosts KFC, Burger King, and Vida e Caffè. The application seeks to regularise the land use by changing the zoning to allow permanent business rights and future expansion.
Why is a rezoning application required?
Under City planning regulations, every property may only be used in line with its zoning and title deed conditions. Where the use differs, a rezoning application must be lodged.
This triggers a public process where:
- Notices are published in the Gazette and on site,
- The community is invited to submit objections or comments, and
- The Municipal Planning Tribunal considers the application before making a decision.
The current application is part of this process.
What does the application propose?
The submitted plans and motivation documents indicate:
- Two drive-thru restaurants (Burger King and KFC),
- Additional retail tenants, such as Seattle Coffee, a pizza shop, and Vida e Caffè,
- Permanent rezoning of the site to Business 1, which allows a broad range of business uses beyond the current restaurants.
Previously, the site was developed with residential flats, which have since been demolished.
Why might this affect residents?
This rezoning, if approved, has long-term implications for the neighbourhood:
- Traffic & congestion – Drive-thrus generate significant car movements. Jan Smuts Avenue is already a high-pressure route and additional traffic may cause bottlenecks.
- Noise & operating hours – Extended hours and constant vehicle activity could impact surrounding residential properties.
- Neighbourhood character – The shift from residential to business rights permanently alters the site’s zoning, changing the balance of uses along Jan Smuts.
- Future precedent – The adjacent property has also been cleared. Granting Business 1 rights here could set a precedent for further rezoning applications in the area.
Key dates
The deadline for objections or comments is: 3 September 2025 (28 days from first Gazette notice).
Late submissions cannot be accepted by law.
How to participate
Residents are encouraged to review the application documents and make their voices heard. Each household must submit its own objection or comment to ensure it is counted.
